:::Det er helt rimelige ønsker, du stiller op her. De er faktisk så rimelige, at de burde gælde for alle artikler, men det er jo ikke tilfældet. Tanken med at bruge en eventuel oversættelse til tysk som en slags "[[probérnål]]" er jo besnærende, men hvor mange af vore artikler kan stå for den prøve? Og omvendt, har du set de tyske og engelske artikler om (omtrent) det samme (se f.eks. [[de:Anfangsverdacht|Anfangsverdacht]] eller [[en:Reasonable_suspicion|Reasonable suspicion]])? Skal de ikke kunne klare en tilsvarende prøve? Så mit spørgsmål er: Hvorfor er det så afgørende i vurderingen af netop denne artikel? - Og hvad er i øvrigt "international lovgivning", taler vi om krigsforbryderdomstolen eller hvor er vi henne?--[[Bruger:Sten|Sten Porse]] 7. sep 2006 kl. 11:45 (CEST)

:::4. States shall assist each other in detecting, arresting and bringing to trial persons suspected of having committed such crimes and, if they are found guilty, in punishing them.
:::5. Persons against whom there is evidence that they have committed war crimes and crimes against humanity shall be subject to trial and, if found guilty, to punishment, as a general rule in the countries in which they committed those crimes. In that connection, States shall co-operate on questions of extraditing such persons.
:::6. States shall co-operate with each other in the collection of information and evidence which would help to bring to trial the persons indicated in paragraph 5 above and shall exchange such information.

In co-operating with a view to the detection, arrest and extradition of persons against whom there is evidence that they have committed war crimes and crimes against humanity and, if found guilty, their punishment, States shall act in conformity with the provisions of the Charter of the United Nations and of the Declaration on Principles of International Law concerning Friendly Relations and Co-operation among States in accordance with the Charter of the United Nations.
 
Så vidt jeg kan læse er pointen, at alle internationale vedtagelser skal optages i de nationale lovsystemer ''for at have retsvirkning'' i de pågældende lande. Det siger vel, at "international ret" altid er formuleret via national lovgivning? Med andre ord: hvordan kan man bedre forklare international ret end ved at referere de nationale bestemmelser?--[[Bruger:Sten|Sten Porse]] 7. sep 2006 kl. 12:18 (CEST)
